Terms of Service
Last updated August 24, 2026
These terms govern use of Tend, intake software operated by FRTC (frtc.ltd). By signing in, you agree to them. If you are accepting on behalf of a practice, you confirm you are able to bind that practice.
Not for emergencies
Tend is not monitored around the clock and must never be relied on to reach anyone urgently. A message that arrives in Tend may not be seen for hours. If someone is in immediate danger, call 911. In the United States, the Suicide & Crisis Lifeline is reachable at any hour by calling or texting 988.
Who may use Tend
Tend is for staff at practices we have agreed to serve. Accounts are created by invitation. You are responsible for what happens under your account, for keeping your password to yourself, and for telling us promptly if you think someone else has access to it. Do not share a login between people — the record of who did what is only worth having if each account is one person.
What Tend is, and is not
Tend is an administrative tool. It tracks enquiries from first contact to a booked consultation. It is notan electronic health record, not a clinical system of record, and not a substitute for one. Once a client is taken on, the practice’s EHR is authoritative. Nothing in Tend is medical advice, and the software makes no clinical judgements — where it summarises or drafts, a person decides what to do with the result.
Your responsibilities
- Use Tend only for the practice’s own intake work, and only with information you are entitled to handle.
- Follow the law that applies to you, including patient privacy rules and the rules on contacting people by text message.
- Do not attempt to reach another practice’s data, probe the service’s security, or work around its limits.
- Do not use Tend to send unsolicited marketing.
Your data
Information a practice puts into Tend belongs to that practice. We handle it on their behalf, as described in our Privacy Policy and in the agreement between us, which includes a business associate agreement where one is required. A practice may ask for an export of its data, or for its deletion, and we will provide it within a reasonable time and subject to any retention the law requires of us.
Connected accounts
Where you connect another service — a Google Calendar, a phone number, a mailbox — you confirm you are entitled to connect it, and that service’s own terms continue to apply. You can disconnect at any time. We are not responsible for those services being unavailable or for what they do with your information under their own terms.
Availability
We work to keep Tend running and to keep your data safe, but the service is provided as it is, without a promise that it will be uninterrupted or free of errors. We may change features, and we will give notice before removing anything a practice depends on. Keep your own records of anything you cannot afford to lose.
Limits
To the extent the law allows, FRTC is not liable for indirect or consequential losses, for lost business, or for loss of data beyond the most recent backup. This does not limit anything that cannot lawfully be limited.
Ending access
A practice may stop using Tend at any time and ask for its data. We may suspend an account that is being used in a way that breaks these terms, puts other practices’ data at risk, or breaks the law — and we will say why.
Changes
We may update these terms. The date at the top will change, and where an update materially affects a practice we will tell them before it takes effect.
Governing law
These terms are governed by the laws of the State of Colorado, United States.
